Scope and acceptance of the Terms and Conditions
The content of the contract formed between us is determined – alongside the provisions of the applicable mandatory legislation – by these General Terms and Conditions (hereinafter: Terms and Conditions). Accordingly, these Terms and Conditions set out the rights and obligations of you and us, the conditions for the formation of the contract, the performance deadlines, the delivery and payment conditions, the liability rules, and the conditions for exercising the right of withdrawal.
Any technical information necessary for using the Website that is not contained in these Terms and Conditions is provided by other information available on the Website.
Before finalising your order, you are required to familiarise yourself with the provisions of these Terms and Conditions.
Language of the contract, form of the contract
The language of contracts falling within the scope of these Terms and Conditions is Hungarian.
Contracts falling within the scope of these Terms and Conditions do not qualify as contracts concluded in writing, and are not filed by the Seller.
E-invoicing
Our company uses electronic invoices pursuant to Section 175 of Act CXXVII of 2007. By accepting these Terms and Conditions, you give your consent to the use of electronic invoices.
Prices
Prices are in Hungarian forints and include 27% VAT. The possibility that the Seller may modify prices for business policy reasons cannot be excluded. Any modification of prices does not apply to contracts already concluded. If the Seller has incorrectly indicated the price and an order has been received for the Goods, but a contract has not yet been concluded between the parties, the Seller shall proceed in accordance with the "Procedure in the event of an incorrect price" section of these Terms and Conditions.
Procedure in the event of an incorrect price
A price shall be considered obviously incorrectly indicated if it is:
- a price of HUF 0,
- a price reduced by a discount, but where the discount is indicated incorrectly (e.g. for Goods priced at HUF 1,000, the Goods are offered for HUF 500 while indicating a 20% discount).
If an incorrect price is indicated, the Seller will offer the option of purchasing the Goods at the correct price; with this information, the Buyer may decide whether to order the Goods at the correct price or to cancel the order without any adverse legal consequences.
Complaint handling and legal remedies
The consumer may submit consumer complaints regarding the Goods or the Seller's activity at the following contact details:
-
by post, at 1135 Budapest, Tahi utca 53-57. 4th floor, 6a.,
- by email, at hello@florm.hu,
- by phone, at +36 20 436 0836 .
The consumer may communicate their complaint to the business orally or in writing, relating to conduct, an activity or an omission of the business, or of a person acting in the interest of or on behalf of the business, that is directly connected with the distribution or sale of goods to consumers.
The business must investigate an oral complaint immediately and remedy it as necessary. If the consumer disagrees with the handling of the complaint, or if immediate investigation of the complaint is not possible, the business must immediately draw up minutes of the complaint and its position on it, and hand a copy of this to the consumer on the spot in the case of an oral complaint communicated in person. In the case of an oral complaint communicated by telephone or other electronic communications service, the minutes must be sent to the consumer at the latest within 30 days, together with the substantive reply, in accordance with the requirements applicable to the reply to a written complaint. In all other respects, the business must proceed as set out below regarding written complaints. The business must respond to a written complaint substantively in writing within thirty days of its receipt and take steps to communicate it, unless a directly applicable legal act of the European Union provides otherwise. A shorter deadline may be set by a legal regulation, and a longer deadline by an Act of Parliament. The business must give reasons for rejecting a complaint. The business must assign a unique identification number to an oral complaint communicated by telephone or other electronic communications service.
The minutes recorded on the complaint must contain the following:
- the consumer's name and address,
- the place, time and method of submitting the complaint,
- a detailed description of the consumer's complaint, and a list of the documents and other evidence presented by the consumer,
- the business's statement of its position on the consumer's complaint, if immediate investigation of the complaint is possible,
- the signature of the person recording the minutes and – except in the case of an oral complaint communicated by telephone or other electronic communications service – the signature of the consumer,
- the place and time the minutes were recorded,
- in the case of an oral complaint communicated by telephone or other electronic communications service, the complaint's unique identification number.
The business must retain the minutes recorded on the complaint and the copy of the reply for three years, and present them to the supervisory authorities upon request.
If a complaint is rejected, the business must inform the consumer in writing as to which authority or conciliation body the consumer may turn to with the complaint, depending on its nature. The information must also include the registered seat, telephone and internet contact details, and correspondence address of the competent authority or of the conciliation body according to the consumer's place of residence or stay. The information must also cover whether the business makes use of the conciliation body procedure to settle the consumer dispute. If any consumer dispute that may arise between the Seller and the consumer is not resolved through negotiations, the following legal remedies are available to the consumer:
Consumer protection procedure
A complaint may be lodged with the consumer protection authorities. If the consumer detects a violation of their consumer rights, they are entitled to lodge a complaint with the consumer protection authority competent for their place of residence. Following review of the complaint, the authority decides whether to conduct a consumer protection procedure. First-instance consumer protection authority tasks are carried out by the metropolitan and county government offices competent for the consumer's place of residence; a list of these is available at: http://www.kormanyhivatal.hu/
Court proceedings
The customer is entitled to enforce a claim arising from a consumer dispute before a court, within civil proceedings, in accordance with the provisions of Act V of 2013 on the Civil Code and Act CXXX of 2016 on the Code of Civil Procedure.
Conciliation Board procedure
Please be advised that you may raise a consumer complaint against us. If we reject your consumer complaint, you are also entitled to turn to the Conciliation Board competent for your place of residence or stay: the condition for initiating a conciliation board procedure is that the consumer has attempted to settle the disputed matter directly with the business concerned. At the consumer's request, a conciliation board other than the competent one, as designated in the consumer's request, shall have jurisdiction over the proceedings instead of the competent board.
The business is subject to a duty of cooperation in the conciliation board procedure.
This includes the obligation of businesses to send a response upon the conciliation board's request, as well as the obligation to appear before the conciliation board ("ensuring the participation of a person authorised to reach a settlement at the hearing").
If the business's registered seat or premises are not registered in the county of the chamber operating the territorially competent conciliation board, the business's duty of cooperation extends to offering the possibility of concluding a written settlement that meets the consumer's claim.
In the event of a breach of the above duty of cooperation, the consumer protection authority has jurisdiction, under which, as a result of the change in legislation, a mandatory fine must be imposed in the event of unlawful conduct by businesses, and there is no possibility of waiving the fine. In addition to the Consumer Protection Act, the relevant provision of the act on small and medium-sized enterprises has also been amended, so that the imposition of the fine cannot be waived for small and medium-sized enterprises either.
The amount of the fine for small and medium-sized enterprises may range from HUF 15,000 to HUF 500,000, while for a business subject to the Accounting Act with annual net revenue exceeding HUF 100 million that does not qualify as a small or medium-sized enterprise, it may range from HUF 15,000 up to 5% of the business's annual net revenue, but not more than HUF 500 million. By introducing the mandatory fine, the legislator aims to reinforce cooperation with the conciliation boards and to ensure the active participation of businesses in the conciliation board procedure.
The conciliation board has jurisdiction to settle consumer disputes outside of court proceedings. The task of the conciliation board is to attempt to bring about a settlement between the parties in order to resolve the consumer dispute and, if this is unsuccessful, to make a decision in the matter to ensure the simple, quick, effective and cost-efficient enforcement of consumer rights. At the request of the consumer or the business, the conciliation board provides advice regarding the rights due to, and the obligations imposed on, the consumer.
The conciliation board's procedure is initiated at the consumer's request. The request must be submitted in writing to the president of the conciliation board: the requirement of being in writing may be satisfied by letter, telegram, telex or fax, as well as by any other means that enables the addressee to durably store data addressed to them for a period appropriate to the purpose of the data, and to display the stored data in unchanged form and content. The request must contain
- the consumer's name and place of residence or stay,
- the name, registered seat or relevant premises of the business concerned by the consumer dispute,
- if the consumer requested jurisdiction of a board other than the competent one, the designation of the requested board,
- a brief description of the consumer's position, the facts supporting it, and the evidence thereof,
- the consumer's statement that the consumer has directly attempted to settle the disputed matter with the business concerned,
- the consumer's statement that no other conciliation board procedure has been initiated in the matter, no mediation procedure has been commenced, no statement of claim has been filed, and no application for the issuance of an order for payment has been submitted,
- a motion for the board's decision,
- the consumer's signature.
The request must be accompanied by the document, or a copy (extract) thereof, the content of which the consumer relies on as evidence, in particular the business's written statement on the rejection of the complaint, or, in the absence thereof, other written evidence available to the consumer of having attempted the required consultation.
If the consumer acts through a proxy, the power of attorney must be attached to the request.

Online dispute resolution platform
The European Commission has set up a website on which consumers can register, giving them the opportunity to settle disputes relating to online purchases by filling in a request, avoiding court proceedings. This way, consumers can enforce their rights without being hindered, for example, by distance.
If you wish to make a complaint about Goods or a service purchased online and do not necessarily want to turn to a court, you can make use of the online dispute resolution tool.
On the portal, you and the trader against whom you have made the complaint can jointly select the dispute resolution body you wish to entrust with handling the complaint.
The online dispute resolution platform is available at: https://webgate.ec.europa.eu/odr/main/?event=main.home.show&lng=HU

Correction of data entry errors - Responsibility for the accuracy of the data provided
During the ordering process, before finalising your order, you have the continuous option of modifying the data you have entered (clicking the back button in your browser opens the previous page, so the data entered can be corrected even if you have already moved on to the next page). Please note that it is your responsibility to ensure that the data you provide is entered accurately, since the Goods will be invoiced and delivered based on the data you provide. Please also note that an incorrectly provided email address, or a full mailbox associated with it, may result in the confirmation not being delivered and may prevent the contract from being formed. If the Buyer has finalised their order and discovers an error in the data provided, they must initiate a modification of their order as soon as possible. The Buyer may report the need to modify an erroneous order to the Seller by an email sent from the email address given at the time of ordering, or by telephone.
Use of the website
Purchasing is not tied to registration.
The purchasing process
- Selecting the Product: By clicking on the product categories on the website, you can select the desired product family and, within it, the individual products. By clicking on individual products, you will find the product's photo, description and price. When making a purchase, you must pay the price shown on the website. The products are marked with illustrative photographs. Accessories and decorative elements shown in the photographs are not part of the product, unless specifically highlighted in the product description. Please note that we accept no liability for any typographical errors or incorrect data!
-
Adding to cart: After selecting the Product, you can add – any number of – products to the cart by clicking the "Add to cart" button, without thereby incurring any obligation to purchase or pay, since adding an item to the cart does not qualify as making an offer.
We recommend adding a product to the cart even if you are not sure whether you wish to purchase it, since this lets you review, with a single click, which products you have currently selected, and view and compare them on a single screen.
The contents of the Cart can be freely modified until the order is finalised – until the "Finalise order" button is pressed – items can be removed from the cart as desired, further items can be added to the cart, and the desired quantity of a product can be changed.
If you add the selected product to the Cart, a separate window pops up with the text "The product has been added to the cart". If you do not wish to select any more products, click the "Go to cart" button! If you would like to view the selected product again, or add another product to the cart, click the "Back to product" button!
-
Viewing the Cart: While using the website, you can check the contents of the cart at any time by clicking the "View cart" icon at the top of the website. Here you can remove selected products from the cart, or change the quantity of a product.
After pressing the "Update cart" button, the system displays information corresponding to the data you have changed, including the price of the products placed in the cart.
If you do not wish to select any further products to add to the cart, you can continue the purchase by pressing the "Order" button.
-
Providing buyer details: After pressing the "Order" button, the contents of the cart are displayed, along with the total purchase price payable by you for the products you have selected. In the "Delivery service" box, you must indicate whether you wish to collect the ordered product in person (personal collection) or request delivery. In the case of delivery, the system will indicate the delivery fee, which you are required to pay when ordering.
In the "User details" text box you can enter your email address, and in the "Billing information" text box your full name, address and phone number. In the "Delivery information" text box, the system automatically stores the data provided in the "Billing information" section. If you would like the delivery sent to a different address, please remove the tick. In the "Comment" text box you may enter any further information you wish.
- Reviewing the order: After filling in the above text boxes, you can continue the ordering process by clicking the "Continue to the next step" button, or you can delete/correct the data entered so far and return to the contents of the Cart by clicking the "Cancel" button. If you click "Continue to the next step", you will arrive at the "Order review" page. Here you can see a summary of the data you previously provided, including the contents of the Cart, the user, billing and delivery details, and the amount payable by you (you can no longer change this data here, except by clicking the "Back" button).
Finalising the order (making an offer)
Once you have confirmed that the contents of the cart correspond to the Goods you wish to order, and that your details are correctly entered, you can finalise your order by clicking the "Order" button. The information published on the website does not qualify as an offer by the Seller to conclude a contract. For orders falling within the scope of these Terms and Conditions, you qualify as the offeror.
By pressing the "Order" button, you expressly acknowledge that your offer is to be regarded as made, and that your declaration – if confirmed by the Seller in accordance with these Terms and Conditions – gives rise to a payment obligation. You are bound by your offer for a period of 48 hours. If the Seller does not confirm your offer within 48 hours in accordance with these general terms and conditions, you are released from being bound by your offer.
Processing the order, formation of the contract
You may place an order at any time. The Seller will confirm your offer by email at the latest on the business day following the sending of your offer. The contract is formed when the confirmation email sent by the Seller becomes accessible to you in your mailbox.
Payment methods

Performance deadline
The general performance deadline for an order is a maximum of 30 days from confirmation of the order. In the event of the Seller's delay, the Buyer is entitled to set an additional deadline. If the Seller does not perform within this additional deadline, the Buyer is entitled to withdraw from the contract.
Retention of title, reservation of ownership
If you have previously ordered Goods but did not take delivery of them (not including cases where you exercised your right of withdrawal), or the Goods were returned to the seller marked as unclaimed, the Seller shall make performance of the order conditional on advance payment of the purchase price and delivery costs.
The Seller may withhold delivery of the Goods until it has confirmed that payment of the price of the Goods has been successfully made using the electronic payment solution (including cases where, for Goods paid by bank transfer, the Buyer transfers the purchase price in the currency of their Member State and, due to currency conversion and bank commissions and costs, the Seller does not receive the full amount of the purchase price and delivery fee). If the price of the Goods has not been paid in full, the Seller may call on the Buyer to supplement the purchase price.
Sales abroad
The Seller does not distinguish, through the use of the Website, between Buyers within the territory of Hungary and those within the territory of the European Union outside Hungary. In the absence of a different provision of these Terms and Conditions, the Seller ensures delivery/collection of ordered Goods within the territory of Hungary.
These Terms and Conditions also apply to purchases from outside Hungary, provided that, in accordance with the requirements of the relevant regulation, for the purposes of this section, a buyer qualifies as a consumer who is a national of a Member State, or has their place of residence in a Member State, or as a business that has a place of establishment in a Member State, and who purchases goods or uses a service within the European Union solely for end-use purposes, or acts with such intent. A consumer qualifies as a natural person acting for purposes which are outside their trade, business, craft or profession.
The language of communication and of the purchase is primarily Hungarian; the Seller is not obliged to communicate with the Buyer in the language of the Buyer's Member State.
The Seller is not obliged to comply with non-contractual requirements set out in the national law of the Buyer's Member State in relation to the Goods concerned, such as labelling or sector-specific requirements, or to inform the Buyer of such requirements.
In the absence of a different provision, the Seller applies Hungarian VAT to all Goods.
The Buyer may exercise their legal remedies in accordance with these Terms and Conditions.
If an electronic payment solution is used, payment is made in the currency specified by the Seller,
The Seller may withhold delivery of the Goods until it has confirmed that payment of the price of the Goods and the delivery fee has been made successfully and in full using the electronic payment solution (including cases where, for Goods paid by bank transfer, the Buyer transfers the purchase price (delivery fee) in the currency of their Member State and, due to currency conversion and bank commissions and costs, the Seller does not receive the full amount of the purchase price). If the price of the Goods has not been paid in full, the Seller may call on the Buyer to supplement the purchase price.
In order to deliver the Goods, the Seller provides non-Hungarian Buyers with the same delivery options available to Hungarian Buyers.
If, under these Terms and Conditions, the Buyer may request delivery of the Goods to the territory of Hungary or to the territory of any other European Union Member State, a non-Hungarian buyer may likewise request this using any delivery method specified in these Terms and Conditions.
If, under these Terms and Conditions, the Buyer may choose personal collection of the Goods from the Seller, a non-Hungarian Buyer may likewise make use of this option.
Otherwise, the Buyer may request that delivery of the Goods abroad be arranged at their own expense. Hungarian Buyers are not entitled to this option.
The Seller performs the order once the delivery fee has been paid; if the Buyer does not pay the delivery fee to the Seller, or does not arrange their own delivery by the previously agreed date, the Seller shall terminate the contract and refund the purchase price already paid to the Buyer.
Consumer information
Information on the consumer buyer's right of withdrawal
Under Section 8:1(1), point 3 of the Civil Code, only a natural person acting outside their trade, self-employed occupation or business activity qualifies as a consumer, so legal persons may not exercise the right of withdrawal without justification!
Pursuant to Section 20 of Government Decree 45/2014 (II. 26.), the consumer has the right to withdraw without justification. The consumer may exercise their right of withdrawal
- in the case of a contract for the sale of Goods,
- for the Goods,
- in the case of the sale of several Goods, if the individual Goods are delivered at different times, for the Goods delivered last,
within a period counted from the day on which the Goods are taken possession of by the consumer or by a third party, other than the carrier, designated by the consumer, which period is 14 days.
The withdrawal period provided for by Government Decree 45/2014 (II. 26.) is 14 days; any period of withdrawal beyond this granted by the Seller under these Terms and Conditions is a voluntary undertaking beyond what is required by legislation.
The provisions of this section do not affect the consumer's right to exercise the right of withdrawal set out in this section also during the period between the date of conclusion of the contract and the date of receipt of the Goods.
If the offer to conclude the contract was made by the consumer, the consumer has the right to withdraw the offer before the conclusion of the contract, which terminates the offeror's being bound in relation to the conclusion of the contract.
Declaration of withdrawal, exercising the consumer's right of withdrawal or termination
The consumer may exercise the right granted under Section 20 of Government Decree 45/2014 (II. 26.) by means of a clear statement to that effect, or by using the sample withdrawal statement, which can also be downloaded from the website.
The consumer's declaration of withdrawal
The right of withdrawal shall be considered to have been exercised within the deadline if the consumer sends their declaration within the deadline. The deadline is 14 days.
In the case of withdrawal or termination in writing, it is sufficient to send the declaration of withdrawal or termination within 14 days.
The withdrawal period provided for by Government Decree 45/2014 (II. 26.) is 14 days; any period of withdrawal beyond this granted by the Seller under these Terms and Conditions is a voluntary undertaking beyond what is required by legislation.
The burden of proving that the right of withdrawal has been exercised in accordance with this provision lies with the consumer.
The Seller must confirm receipt of the consumer's declaration of withdrawal on an electronic data carrier without delay after it is received.
The Seller's obligations in the event of the consumer's withdrawal
The Seller's obligation to refund
If the consumer withdraws from the contract in accordance with Section 22 of Government Decree 45/2014 (II. 26.), the Seller shall refund the full amount paid by the consumer as consideration, including costs incurred in connection with performance, such as the delivery fee, at the latest within fourteen days of becoming aware of the withdrawal. Please note that this provision does not apply to any additional costs arising from the consumer's choice of a delivery method other than the least expensive standard delivery method offered by the Seller.
Method of the Seller's refund obligation
In the event of withdrawal or termination in accordance with Section 22 of Government Decree 45/2014 (II. 26.), the Seller shall refund the amount due to the consumer using the same payment method used by the consumer. With the consumer's express consent, the Seller may use a different payment method for the refund, but the consumer may not be charged any additional fee as a result. The Seller shall not be liable for any delay resulting from an incorrect and/or inaccurate bank account number or postal address provided by the Consumer.
Additional costs
If the consumer expressly chooses a delivery method other than the least expensive standard delivery method offered, the Seller is not required to refund the resulting additional costs. In such a case, our refund obligation is limited to the amount of the standard delivery fee indicated.
Right of retention
The Seller may withhold the amount due to the consumer until the consumer has returned the Goods, or has provided conclusive proof that they have been sent back; whichever of the two occurs earlier shall be taken into account. We are not able to accept items sent cash-on-delivery or with postage due.
The consumer's obligations in the event of withdrawal or termination
Return of the Goods
If the consumer withdraws from the contract in accordance with Section 22 of Government Decree 45/2014 (II. 26.), they must return the Goods without delay, but at the latest within fourteen days of communicating the withdrawal, or hand them over to the Seller or to a person authorised by the Seller to receive the Goods. The return shall be deemed to have been made within the deadline if the consumer sends the Goods before the deadline expires.
Bearing the direct costs of returning the Goods
The consumer bears the direct cost of returning the Goods. The Goods must be sent back to the Seller's address. If the consumer terminates a contract for the provision of a service concluded away from business premises or at a distance after performance has begun, they must pay the business a fee proportionate to the service performed up to the time the termination was communicated to the business. The amount payable proportionately by the consumer must be determined on the basis of the total consideration specified in the contract, including tax. If the consumer proves that the total amount thus determined is excessively high, the proportionate amount must be calculated on the basis of the market value of the services performed up to the date the contract was terminated. Please note that we are not able to accept Goods returned cash-on-delivery or with postage due.
The consumer's liability for depreciation
The consumer is liable for any depreciation resulting from use beyond what is necessary to establish the nature, characteristics and functioning of the Goods.
The right of withdrawal may not be exercised in the following cases
The Seller expressly draws your attention to the fact that you may not exercise your right of withdrawal in the cases set out in Section 29(1) of Government Decree 45/2014 (II.26.):
- after the service has been performed in full, provided that, if the contract imposes a payment obligation on the consumer, this exception may only be relied on if performance began with the consumer's express prior consent and with the consumer's acknowledgement that they will lose their right of withdrawal once the business has fully performed the contract;
- in respect of Goods or a service whose price depends on fluctuations in the financial market beyond the business's control, which may also occur within the period for exercising the right of withdrawal;
- in respect of non-prefabricated Goods manufactured on the basis of the consumer's instructions or at the consumer's express request, or Goods that have been clearly personalised for the consumer;
- in respect of Goods that are perishable or retain their quality for only a short period;
- in respect of sealed Goods which cannot be returned after opening following delivery, for health protection or hygiene reasons;
- in respect of Goods which, by their nature, become inseparably mixed with other items after delivery;
- in respect of alcoholic beverages whose actual value depends on fluctuations in the market beyond the business's control, and whose price was agreed by the parties at the time of concluding the sales contract, but performance of the contract only takes place after the thirtieth day following its conclusion;
- in respect of a works contract where the business visits the consumer at the consumer's express request for the purpose of carrying out urgent repair or maintenance work;
- in respect of the sale of sealed audio or video recordings, or of sealed computer software, if the consumer has opened the packaging after delivery;
- in respect of newspapers, periodicals and magazines, except for subscription contracts;
- in respect of contracts concluded at a public auction;
- in respect of a contract for the provision of accommodation other than for residential purposes, transport, car rental, catering or services related to leisure activities, if a specific date or time limit for performance has been stipulated in the contract;
- in respect of digital content supplied on a non-tangible medium, if the Seller began performance with the consumer's express prior consent, and the consumer, at the same time as giving this consent, acknowledged that they would lose their right of withdrawal once performance had begun, and the business sent confirmation to the consumer.
Requirements for conformity of performance
General requirements for conformity of performance for goods and goods with digital elements sold under a consumer contract
At the time of performance, the Goods and the performance must comply with the requirements set out in Government Decree 373/2021 (VI.30.).
For performance to be considered conforming with the contract, the Goods that are the subject of the contract must
- correspond to the description, quantity, quality and type specified in the contract, and possess the functionality, compatibility, interoperability and other characteristics specified in the contract
- be suitable for any particular purpose made known by the consumer to the Seller at the latest at the time of concluding the contract, and which the Seller has accepted
- be supplied with all accessories and instructions specified in the contract – including instructions on installation, setup instructions, and customer support – and
- provide the updates specified in the contract.
For performance to be considered conforming with the contract – furthermore – the Goods that are the subject of the contract must
- be fit for the purposes for which goods of the same type would normally be used, taking into account any applicable legislation, technical standard or, in the absence of a technical standard, applicable code of conduct in the sector concerned
- possess the quantity, quality and performance features and other characteristics – including, in particular, functionality, compatibility, accessibility, continuity and security – which are normal for goods of the same type and which the consumer may reasonably expect, having regard to any public statement made by the Seller, its representative or another person in the sales chain about the specific characteristics of the Goods, in particular in advertising or on labelling
- be supplied with such accessories and instructions – including packaging and installation instructions – as the consumer may reasonably expect, and correspond to the characteristics and description of any sample or model of the Goods made available by the business, or of any trial version, prior to the conclusion of the contract.
The Goods need not correspond to the above public statement if the Seller proves that
- it was not, and could not reasonably have been, aware of the public statement
- the public statement had been suitably corrected by the time the contract was concluded, or
- the public statement could not have influenced the decision to purchase the Goods.
Requirements for conformity of performance in the case of the sale of Goods under a consumer contract
The Seller performs defectively if the defect in the Goods results from improper installation, provided that
- the installation forms part of the sales contract and was carried out by the Seller, or was carried out under the Seller's responsibility; or
- the installation was to be carried out by the consumer, and the improper installation results from a shortcoming in the installation instructions provided by the Seller – or, in the case of Goods with digital elements, by the provider of the digital content or digital service.
If, under the sales contract, the Goods are installed by the Seller, or installation takes place under the Seller's responsibility, performance shall be deemed completed by the Seller when installation is completed.
If, in the case of Goods with digital elements, the sales contract provides for continuous supply of the digital content or digital service over a specified period, the Seller is liable for a defect in the Goods relating to the digital content if the defect occurs or becomes apparent within two years of performance of the Goods, in the case of continuous supply for a period not exceeding two years.
Requirements for conformity of performance in the case of goods with digital elements sold under a consumer contract
In the case of goods with digital elements, the Seller must ensure that the consumer is notified of updates to the digital content of the Goods or to the related digital service – including security updates – which are necessary to maintain the conformity of the Goods, and must ensure that the consumer actually receives them.
The Seller must make the update available, if the sales contract
- provides for a single supply of the digital content or digital service, for the period the consumer may reasonably expect given the type and purpose of the goods and the digital elements, and having regard to the circumstances and nature of the contract; or
- provides for the continuous supply of the digital content over a specified period, for a period of two years from performance of the Goods, in the case of continuous supply for a period not exceeding two years.
If the consumer fails to install, within a reasonable time, updates made available to them, the Seller is not liable for a defect in the Goods resulting solely from the lack of the relevant update, provided that
- the Seller informed the consumer of the availability of the update and of the consequences of failing to install it; and
- the consumer's failure to install the update, or their incorrect installation of it, was not attributable to a shortcoming in the installation instructions provided by the Seller.
Defective performance cannot be established if, at the time the contract was concluded, the consumer was separately informed that a specific characteristic of the Goods differs from what is described here, and the consumer expressly and separately accepted this deviation when concluding the sales contract.
Information on product warranty and implied warranty for conformity of the Goods
This section of the consumer information notice has been prepared pursuant to the authorisation under Section 9(3) of Government Decree 45/2014 (II.26.), taking into account Annex 3 of Government Decree 45/2014 (II.26.).
Implied warranty for conformity
In which cases can you exercise your right to an implied warranty for conformity?
In the event of defective performance by the Seller, you may assert an implied-warranty claim against the Seller in accordance with the rules of the Civil Code, and, in the case of a consumer contract, in accordance with the rules of Government Decree 373/2021 (VI.30.).
What rights are you entitled to under your implied-warranty claim?
General rules of implied-warranty rights
You may, at your discretion, assert the following implied-warranty claims:
You may request a repair or a replacement, unless performance of the claim you have chosen is impossible, or would impose disproportionate additional costs on the Seller compared with performance of your other claim. If you did not, or could not, request a repair or replacement, you may request a proportionate reduction of the consideration, or you may repair the defect yourself or have it repaired by someone else at the Seller's expense, or, as a last resort, you may withdraw from the contract.
You may switch from the implied-warranty right you have chosen to another one, but you shall bear the cost of switching, unless it was justified, or was caused by the Seller.
In the case of a consumer contract, unless proven otherwise, a defect discovered within one year from the date of performance of the Goods and of goods with digital elements shall be presumed to have already existed at the time of performance, unless this presumption is incompatible with the nature of the Goods or with the nature of the defect.
For used Goods, warranty rights are generally different from the general rules. Defective performance can also occur in relation to used Goods; however, the circumstances under which the Buyer could expect certain defects to occur must be taken into account. Due to wear, the occurrence of certain defects becomes increasingly common, and as a result it cannot be assumed that used Goods will have the same quality as newly purchased Goods. Accordingly, the Buyer may only assert their warranty rights in respect of defects that go beyond, and arose independently of, defects resulting from use. If the used Goods are defective and the Buyer qualifying as a Consumer was informed of this at the time of purchase, the Service Provider bears no liability in respect of the known defect.
For buyers who do not qualify as consumers, the deadline for asserting an implied-warranty right is 1 year, starting from the date of performance (handover).
Special rules of implied-warranty rights for Goods and goods with digital elements sold under a consumer contract
In the case of a contract between a Consumer and a business – for the sale of goods qualifying as movable property, or for the supply of digital content – the provisions set out under "General rules of implied-warranty rights" apply to the Consumer, subject to the deviations set out in this section.
In the case of a contract between a Consumer and a business – for the sale of goods qualifying as movable property, or for the supply of digital content – in exercising their implied-warranty rights, the Consumer may not repair the defect themselves, or have it repaired by someone else, at the Seller's expense.
The Seller may refuse to bring the goods into conformity if repair or replacement is impossible, or would impose disproportionate additional costs on the Seller, taking into account all circumstances, including the value the Goods would have if free of defects, and the severity of the breach of contract.
The consumer is also entitled – in proportion to the severity of the breach of contract – to request a proportionate reduction of the consideration, or to terminate the sales contract, if
- the Seller did not carry out the repair or replacement, or carried it out but failed, in part or in full, to meet the following conditions
- the Seller must ensure, at its own expense, the collection of the replaced goods
- if the repair or replacement requires the removal of goods that were installed in accordance with their nature and purpose – before the defect became apparent – the obligation to repair or replace includes removal of the non-conforming goods and installation of the replacement or repaired goods, or bearing the costs of removal and installation.
- refused to bring the goods into conformity
- a repeated performance defect occurred, despite the Seller having attempted to bring the goods into conformity
- the defect in performance is of such severity as to justify an immediate price reduction or immediate termination of the sales contract, or
- the Seller did not undertake to bring the goods into conformity, or it is clear from the circumstances that the business will not bring the goods into conformity within a reasonable time or without significant inconvenience to the consumer.
If the consumer wishes to terminate the sales contract on the grounds of defective performance, the burden of proving that the defect is insignificant lies with the Seller.
The Consumer is entitled to withhold, in whole or in part, the remaining portion of the purchase price – in proportion to the severity of the breach of contract – until the Seller fulfils its obligations relating to the conformity of performance and to defective performance.
The following generally applicable rule applies:
- the Seller must ensure, at its own expense, the collection of the replaced goods
- if the repair or replacement requires the removal of goods that were installed in accordance with their nature and purpose – before the defect became apparent – the obligation to repair or replace includes removal of the non-conforming goods and installation of the replacement or repaired goods, or bearing the costs of removal and installation.
The reasonable period available for repairing or replacing the goods shall be calculated from the time the Consumer notified the business of the defect.
The consumer must make the goods available to the business in order for the repair or replacement to be carried out.
A reduction of the consideration is proportionate if its amount equals the difference between the value the Consumer would have received had performance been in conformity with the contract, and the value of the goods actually received by the Consumer.
The Consumer's implied-warranty right to terminate the sales contract may be exercised by a declaration of intent addressed to the Seller, expressing the decision to terminate.
If the defective performance only affects a specific part of the goods supplied under the sales contract, and the conditions for exercising the right to terminate the contract are met in respect of that part, the Consumer may terminate the sales contract only in respect of the defective goods; however, they may also terminate it in respect of any other goods acquired together with them if the Consumer cannot reasonably be expected to keep only the goods that conform to the contract.
If the Consumer terminates the sales contract in its entirety, or in respect of a part of the goods supplied under the sales contract, then
- the Consumer must, at the Seller's expense, return the goods concerned to the Seller, and
- the Seller must, without delay, refund to the Consumer the purchase price paid for the goods concerned, once it has received the goods or proof of their return.
Within what time limit can you assert your implied-warranty claim?
You are required to report the defect without delay after discovering it. A defect reported within two months of its discovery shall be considered to have been reported without delay. Please note, however, that you may no longer assert your implied-warranty rights after the two-year limitation period, counted from performance of the contract, has expired. If the subject of the contract between the consumer and the business is a used item, the parties may agree on a shorter limitation period; however, even in this case, a limitation period shorter than one year may not be validly stipulated.
Against whom can you assert your implied-warranty claim?
You may assert your implied-warranty claim against the Seller.
What other conditions apply to asserting your implied-warranty rights?
Within six months of performance (one year in the case of the sale of goods), there is no other condition for asserting your implied-warranty claim beyond reporting the defect, if you prove that the Goods or the service was provided by the Seller. However, after six months (one year in the case of the sale of goods) have elapsed from performance, you are required to prove that the defect you have discovered already existed at the time of performance.
Product warranty
- In which cases can you exercise your right to a product warranty? In the event of a defect in movable property (Goods), you may, at your discretion, assert either an implied-warranty claim or a product-warranty claim.
- What rights are you entitled to under your product-warranty claim? As a product-warranty claim, you may only request the repair or replacement of the defective Goods.
- In which cases are the Goods considered defective? The Goods are defective if they do not meet the quality requirements in effect at the time they were placed on the market, or if they do not have the characteristics described by the manufacturer.
- Within what time limit can you assert your product-warranty claim? You may assert your product-warranty claim within two years of the Goods being placed on the market by the manufacturer. After this deadline expires, you lose this right.
- Against whom, and under what other conditions, can you assert your product-warranty claim? You may only assert your product-warranty claim against the manufacturer or distributor of the movable property. You must prove the defect in the Goods when asserting a product-warranty claim.
-
In which cases is the manufacturer (distributor) exempt from its product-warranty obligation? The manufacturer (distributor) is exempt from its product-warranty obligation only if it can prove that:
- it did not manufacture or place the Goods on the market in the course of its business activity, or
- the defect was not recognisable, according to the state of science and technology, at the time the Goods were placed on the market, or
- the defect in the Goods results from the application of legislation or a mandatory official requirement.
It is sufficient for the manufacturer (distributor) to prove one such reason in order to be exempt.
Please note that you may not assert an implied-warranty claim and a product-warranty claim simultaneously and in parallel for the same defect. However, if your product-warranty claim is successfully asserted, you may assert an implied-warranty claim against the manufacturer in respect of the replaced Goods or the repaired part.
Warranty
In which cases can you exercise your warranty rights?
Pursuant to Government Decree 151/2003 (IX. 22.) on the mandatory warranty for certain durable consumer goods, the Seller is required to provide a warranty when selling the new durable consumer goods listed in Annex 1 of the Decree (e.g. technical goods, tools, machines), as well as, within the scope specified there, their accessories and components (hereinafter – in this section – collectively referred to as consumer goods).
In addition, the Seller may voluntarily undertake a warranty, in which case it must hand a warranty statement to the buyer qualifying as a Consumer.
The warranty statement must be made available to the Consumer on a durable medium, at the latest at the time of performance of the goods.
The warranty statement must indicate:
- a clear statement that, in the event of defective performance of the goods, the Consumer is entitled, free of charge, to exercise the statutory implied-warranty rights, and that these rights are not affected by the warranty
- the name and address of the party obliged to provide the warranty
- the procedure to be followed by the Consumer in order to enforce the warranty
- the designation of the goods to which the warranty applies, and
- the conditions of the warranty.
What rights are you entitled to, and within what time limit, under a mandatory warranty?
Warranty rights
- Under their warranty right, as a general rule, the Buyer may request a repair or replacement, or may repair the defect themselves, or have it repaired, at the expense of the obligated party, request a price reduction, or, ultimately, withdraw from the contract, if the obligated party has not undertaken to carry out the repair or replacement, is unable to fulfil this obligation within an appropriate deadline while respecting the entitled party's interests, or if the entitled party's interest in the repair or replacement has ceased.
- The Buyer may, at their discretion, assert their claim for repair directly at the Seller's registered seat, at any of its premises or branches, or at the repair service indicated by the Seller on the warranty card.
Deadline for assertion
A warranty claim may be asserted during the warranty period; the warranty period, pursuant to Government Decree 151/2003 (IX. 22.), is:
- one year, for a sale price of at least HUF 10,000 but not exceeding HUF 100,000,
- two years, for a sale price exceeding HUF 100,000 but not exceeding HUF 250,000,
- three years, for a sale price exceeding HUF 250,000.
Failure to meet these deadlines results in forfeiture of the right; however, in the case of repair of the consumer good, the warranty period is extended by the time, starting from the day the item was handed over for repair, during which the Buyer could not use the consumer good as intended due to the defect.
The warranty period begins when the consumer good is handed over to the Buyer, or, if installation is carried out by the Seller or its agent, begins on the day of installation.
If the Buyer has the consumer good installed more than six months after handover, the starting date of the warranty period is the date the consumer good was handed over.
Rules relating to the handling of warranty claims
When handling a repair, the Seller must endeavour to complete the repair within 15 days. The deadline available for the repair begins when the consumer good is received.
If the duration of the repair or replacement exceeds fifteen days, the Seller must inform the Buyer of the expected duration of the repair or replacement.
If, during the first repair of the consumer good within the warranty period, the Seller determines that the consumer good cannot be repaired, the Seller must, unless the buyer instructs otherwise, replace the consumer good within eight days. If replacement of the consumer good is not possible, the Seller must, within eight days, refund to the buyer the purchase price indicated on the document presented by the consumer proving payment for the consumer good – the invoice or receipt issued in accordance with the act on value added tax.
By accepting the Terms and Conditions, the Buyer agrees that this information may also be provided to them electronically, or by another method suitable for proving receipt by the Buyer.
If the Seller is unable to repair the consumer good within 30 days:
- if the Buyer has consented to this, the repair may be completed within a later deadline for them, or
- if the Buyer does not consent to a later completion of the repair, or has not made a statement in this regard, the consumer good must be replaced for them within eight days of the unsuccessful expiry of the thirty-day deadline, or
- if the Buyer does not consent to a later completion of the repair, or has not made a statement in this regard, but replacement of the consumer good is also not possible, the sale price shown on the invoice or receipt for the consumer good must be refunded to them within eight days of the unsuccessful expiry of the thirty-day deadline.
If the consumer good becomes defective for the 4th time, the Buyer is entitled to:
- request a repair from the Seller, or
- instead of requesting a repair, request a proportionate reduction of the purchase price from the Seller pursuant to Section 6:159(2)(b) of Act V of 2013 on the Civil Code, or
- instead of requesting a repair, repair the consumer good themselves, or have it repaired by someone else, at the Seller's expense, pursuant to Section 6:159(2)(b) of Act V of 2013 on the Civil Code, or
- if the Buyer does not exercise these rights (repair, price reduction, and repair by someone else at the Seller's expense), or has not made a statement in this regard, the consumer good must be replaced for them within 8 days; if replacement of the consumer good is not possible, the sale price shown on the invoice or receipt for the consumer good must be refunded to them within eight days.
Exceptions
The provisions set out under "Rules relating to the handling of warranty claims" do not apply to electric bicycles, electric scooters, quads, motorcycles, mopeds, passenger cars, motorhomes, caravans, trailer caravans, trailers, or motorised watercraft.
However, for these Goods too, the Seller must endeavour to fulfil a repair claim within 15 days.
If the duration of the repair or replacement exceeds fifteen days, the Seller must inform the Buyer of the expected duration of the repair or replacement.
What is the relationship between the warranty and other warranty-type rights?
The warranty applies alongside implied-warranty rights (product and implied warranty); the fundamental difference between general warranty rights and the (mandatory) warranty is that, under the (mandatory) warranty, the burden of proof is more favourable to the consumer.
A fixed-installation consumer good subject to the mandatory warranty under Government Decree 151/2003, or one weighing more than 10 kg, or one that cannot be carried as hand luggage on public transport – with the exception of vehicles – must be repaired at the place of use. If the repair cannot be carried out at the place of use, the business or – in the case of a repair claim asserted directly at the repair service – the repair service shall arrange for removal, reinstallation, and transport to and from the place of use.
During the mandatory warranty period, the Seller's undertaking may not impose conditions on the consumer that are less favourable than the rights guaranteed by the rules of the mandatory warranty. After this period, however, the conditions of the voluntary warranty may be freely determined; however, even in this case, the warranty may not affect the existence of the consumer's statutory rights, including those based on the implied warranty.
Right to replacement within three working days
The right to replacement within three working days also applies to sales made through the webshop. A replacement claim within three working days may be asserted for new durable consumer goods falling under Government Decree 151/2003 (IX. 22.); according to this, if someone asserts the right to replacement within 3 working days, the seller must interpret this to mean that the Goods were already defective at the time of sale, and must replace the Goods without further conditions.
When is the Seller exempt from its warranty obligation?
The Seller is exempt from its warranty obligation only if it proves that the cause of the defect arose after performance.
Please note that you may not simultaneously and in parallel assert an implied-warranty claim and a warranty claim, or a product-warranty claim and a warranty claim, for the same defect; otherwise, however, you are entitled to the rights arising from the warranty independently of your warranty-type rights.
